The former law of this Family Courts Act, 2023 was the Family Courts Ordinance, 1985, and the law makers promulgated the said Ordinance, 1985 in view of the Family Court Act of Pakistan, 1964. And, this Ain, 2023 is almost a Bengali version of the former Family Courts Ordinance, 1985, except few changes, e.g. insertion of provisions of amendment of pleadings, increasing amount of court fees from Tk. 25 into Tk. 200, etc.
Mentionable that the provisions of Paribarik Adalat Ain are only procedural laws; for substantive law, respective personal religious laws are to be relied on. This law has been enacted for the purpose of quick disposal of the family dispute matters in summary trial. Therefore, provisions have been made that in some 6 family matters, such as, dissolution of marriage, restitution of conjugal rights, dower, maintenance, guardianship of minor children, and custody of minor children, the suit shall be filed only before the Family Courts and upon said 6 matters the civil court’s jurisdiction has been completely ousted.
